The scope of work for each project will be defined in a separate proposal, quotation, service agreement, invoice, or written communication.

2. Eligibility

  • You have the legal authority to enter into binding agreements.

3. Intellectual Property Ownership

  • Australian Book Writers retains ownership of its proprietary processes, templates, systems, methodologies, website content, graphics, branding, and service materials.

4. Client Responsibilities

Clients agree to:

  • Provide accurate information and project requirements.
  • Submit content that they have the legal right to use.
  • Review deliverables within agreed timelines.
  • Respond to revision requests and communications in a timely manner.
  • Ensure submitted materials do not infringe on the rights of third parties.

Australian Book Writers is not responsible for delays caused by a client’s failure to provide required information or feedback.

5. Payment Terms

Fees

All service fees are provided through quotations, proposals, invoices, or service agreements.

Payment Schedule

Projects may require:

  • Full payment upfront; or
  • A deposit before work begins and subsequent milestone payments.

Work may not commence until the required payment has been received.

Late Payments

Late payments may result in:

  • Project delays
  • Suspension of services
  • Additional administrative fees where permitted by law

6. Revisions

Most services include a limited number of revisions as outlined in the project agreement.

Additional revisions beyond the agreed scope may incur additional fees.

Revision requests must be submitted within the timeframe specified in the project agreement.

7. Refund Policy

Due to the customized nature of publishing and creative services:

  • Deposits and payments for completed work are generally non-refundable.
  • Refund requests will be reviewed on a case-by-case basis.
  • No refunds will be issued for work already completed and delivered.
  • If a project is cancelled after work has commenced, the client may be responsible for payment for work completed up to the cancellation date.

Any specific refund guarantees stated in a service agreement shall take precedence over this policy.

8. Publishing Services Disclaimer

Australian Book Writers provides publishing assistance and support services.

We do not guarantee:

  • Book sales
  • Bestseller status
  • Publishing acceptance by third-party publishers
  • Media coverage
  • Specific marketing outcomes
  • Revenue generation

Publishing and marketing results depend on numerous factors outside our control.

9. Marketing Services Disclaimer

While we use commercially reasonable efforts to promote client projects, we cannot guarantee:

  • Rankings on search engines
  • Social media growth
  • Advertising performance
  • Book sales or conversions
  • Media placements

Past performance does not guarantee future results.

10. Confidentiality

Australian Book Writers agrees to maintain the confidentiality of client manuscripts, drafts, business information, and project materials.

We will not disclose confidential information except:

  • With client authorization
  • To contractors working on the project under confidentiality obligations
  • When required by law

11. Copyright Infringement

Clients warrant that all content submitted:

  • Is owned by them or properly licensed
  • Does not infringe copyrights, trademarks, privacy rights, or other legal rights

Clients agree to indemnify and hold Australian Book Writers harmless from claims arising from materials supplied by the client.

12. Limitation of Liability

To the fullest extent permitted by law:

Australian Book Writers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use of our services
  • Publishing decisions by third parties
  • Marketing performance
  • Business losses
  • Lost profits
  • Lost opportunities

Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

13. Third-Party Services

Certain services may involve third-party providers, including:

  • Publishing platforms
  • Retailers
  • Advertising platforms
  • Audiobook distribution services
  • Printing companies

We are not responsible for the policies, decisions, actions, errors, delays, or service interruptions of third-party providers.

14. Website Use

You agree not to:

  • Use the website for unlawful purposes
  • Attempt unauthorized access to systems or data
  • Introduce malicious software
  • Copy or reproduce website content without permission
  • Interfere with website functionality
